Is the search of a paper bag in a bathroom sink constitutional?
A woman was arrested after the police had a warrant to search her home for stolen jewelry and they found it. When they arrested her she asked to use the bathroom, and the officer briefly looked into the bathroom and noticed a paper bag on the sink. He looked into it and found heroin, and then he seized that evidence. The warrant did not include any paper bags to be searched or that the police should search for heroin. After looking in it, the police found heroin. How would you say that this is unconstitutional? Is there a case that is similar to this?
If it exceeds the scope of the warrant then it is protected by the 4th Amendment. That won't happen because jewelry is likely to be found in a bathroom, and a paper bag could reasonably be considered an appropriate place for such. But, if they were searcing for a grand piano and looked in a paper bag in the bathroom, THEN it would certainly exceed the scope of the warrant.
